Federal Judge Upholds CollegeNET's Universal Forms Engine Patent; Issues Summary Judgment of Infringement by ApplyYourself, Inc
Portland, OR - July 14, 2003:
(--Note on redaction: Seven days after open publication by the Court of all language in its July 7th Opinion & Order, CollegeNET, Inc. published the following press release, which quoted language directly from that Opinion & Order. Upon ApplyYourself's motion (citing confidentiality concerns), however, the Court has since sealed from public viewing the entirety of that Opinion & Order.)

In a sixty-page opinion and order (Summary_Judgment_Opinion.pdf), US Magistrate Judge Dennis Hubel has both denied a motion by ApplyYourself, Inc. for invalidity of CollegeNET's Universal Forms Engine patent (#6,460,042) and found literal infringement by ApplyYourself's i-Class system of key claims in this and one other related CollegeNET patent (#6,345,278). The Universal Forms Engine is the technology framework behind CollegeNET's popular web-based e-commerce services utilized by colleges, universities, and non-profits. These Internet-delivered services include admissions application and prospect management, tuition processing, commencement processing, and alumni membership and contributions management.

Following a favorable ruling December 19, 2002 by the Court on the scope of CollegeNET's '278 Patent, CollegeNET moved for partial summary judgment that ApplyYourself's accused products literally infringe selected claims of each patent. ---------------------------------------------------------------- ---------------------------------------------------------------- ---------------------------------------------------------------- ---------------------------------------------------------------- ---------------------------------------------------------------- ---------------------------------------------------------------- ----------------------------------------------- The Court found that i-Class literally infringes.
